										<content:encoded><![CDATA[<p class="lead p-2 mt-2">TEHRAN (<a href="https://www.irannewsdaily.com/">Iran News</a>) – Iran’s Military Court Dismisses Rumor on Nonsuit Order for <a href="https://irannewsdaily.com/2021/04/iran-rejects-claims-about-intentional-downing-of-ukrainian-flight-752/">Ukrainian Crashed Plane</a> Culprits. The Judicial Organization of Iran’s Armed Forces rejected rumors that a nonsuit order was issued for the culprits of downing of a Ukrainian flight PS752 in early January 2020.</p>

<p class="rtejustify">“As previously mentioned, ten defendants in this case were summoned to the court due to culpability and negligence, and the case was sent to the court after an indictment was issued,” FNA quoted an informed source as saying on Sunday.</p>
<p class="rtejustify">“Immediately after sending the case to the court, the case was studied by the presiding judge and several meetings were held with the [victims’] close relatives and their lawyers for initial preparations before the court hearing,” the source added.</p>
<p class="rtejustify">The Ukrainian plane was shot down with 176 people aboard on January 8, 2020, by Iran’s air defenses, which mistook the aircraft for a military target amid military tensions between Tehran and Washington following the US assassination of Iran’s Lieutenant General Qassem Soleimani in Iraq days earlier.</p>
<p class="rtejustify">Hours before the tragedy happened, Iran had launched a retaliatory missile strike against a US-run base in western Iraq and then put the country’s air defenses on high alert due to increased American aerial activity in the aftermath of the strike.</p>
<p class="rtejustify">Iran acknowledged days later that the mismanagement of an air defense unit’s radar system by its operator was the key human error that led to the accident.</p>
<p class="rtejustify">Tehran has promised that all those culpable in the incident will face trial and said it has allocated 200 million Euros for compensation of the survivors.</p>
<p class="rtejustify">In relevant remarks in April, Spokesman of Iran’s Supreme National Security Council (SNSC) Keivan Khosravi censured efforts made to politicize the Ukrainian plane crash, calling the move as regrettable and inhumane.</p>
<p class="rtejustify">Khosravi said the Ukrainian officials’ allegations on shooting down of a passenger plane over Iran’s sky are unconstructive, as they are trying to politicize the case.</p>
<p class="rtejustify">He described efforts made to take political advantage “of the sentiments of scores of bereaved families” as “regrettable and inhuman,” adding that various independent expert groups have probed into all the existing hypotheses on the event.</p>
<p class="rtejustify">“Unfortunately, Ukrainian officials are trying to ascribe false allegations to Iranian officials in order to politicize this case,” the spokesman noted.</p>
<p class="rtejustify">“Sending the plane’s black boxes to France to decode their contents is the most important reason that proves Iran’s transparency and honesty in its effort to bring to light all details about this incident,” Khosravi said.</p>
<p class="rtejustify">“We have accepted all demands put forth by Ukrainian government, which at times went beyond what was necessary under usual circumstances, so that, there would remain no dark corner in the efforts made to shed light on the truth in this incident,” he added.</p>

<p class="rtejustify">“Regardless of whether Europe has the will or ability to persuade USA to lift all sanctions at once and Washington’s return to its commitments, there will be no possibility for Iran entering the talks in the new fields, more than JCPOA, under any circumstances,” Ali Shamkhani wrote on his twitter page on Tuesday.</p>
<p class="rtejustify">He also used the #activeresistance in his tweet.</p>
<p class="rtejustify">Shamkhani’s remarks followed comments by the US administration’s special envoy for Iran, Rob Malley, who is based in a hotel near the venue of talks in the Austrian capital of Vienna between representatives of Iran and the remaining signatories to the JCPOA.</p>
<p class="rtejustify">In an interview with the American National Public Radio, Malley was asked about a “follow-up” agreement in case the JCPOA gets back on track.</p>
<p class="rtejustify">“What we would pursue is, first of all, a longer agreement. Even though this one lasts quite some time and some of its provisions last forever, of course, it would be better, as in any arms control agreement, to see whether we could get a follow-on deal that extends the timelines,” he replied.</p>
<p class="rtejustify">The Joint Comprehensive Plan of Action (JCPOA) Joint Commission held its 18th round of talks in the Austrian city of Vienna, with representatives of Iran, Russia, China, France and Britain in attendance.</p>
<p class="rtejustify">The US has been absent from the Commission and its discussions since 2018, when former American president Donald Trump took Washington out of the JCPOA and returned the sanctions that the nuclear accord had lifted.</p>
<p class="rtejustify">Iran had announced on Sunday that the country’s officials will have no talks with their American counterparts in Vienna, saying that Tehran will only hold technical negotiations with the Group 4+1.</p>
<p class="rtejustify">“In Vienna, we will not have any talks with the Americans, either directly or indirectly. We will negotiate with the Joint Commission and the G4 + 1 countries, and we will declare our demand and condition to return to the nuclear deal,&#8221; Deputy Foreign Minister Seyed Abbas Araqchi said, and added, &#8220;Our demand and condition is that the US should first fulfill all its nuclear deal undertakings and lift all sanctions, and then we will verify it and return (to our modified undertakings).”</p>
<p class="rtejustify">He described the Tuesday talks with the G4+1 as technical, and said they will focus on the sanctions which should be lifted and the measures that should be adopted and their order and sequence, and the verifying measures which need to be taken.</p>

<p>The top Iranian security official also described the Hezbollah operation in the north of occupied Palestinian lands, during which an Israeli military vehicle was destroyed, as the show of Resistance Front’s will to confront rising threats and warmongering policies of destabilizers (US, Israel and their regional allies).</p>
<p>He further described Hezbollah as an authentic, smart and popular movement which acts in defense of Lebanon’s national interests.</p>
<p>After the Sunday aggression in Lebanon and Syria against Hezbollah forces, the leader of the Resistance movement Hassan Nasrallah had vowed that the aggression would not go unanswered and this afternoon&#8217;s operation seemed to be the promised response to the aggression.</p>

										<content:encoded><![CDATA[<p>“We, as representatives of Resistance Front and Hamas Movement, voice our solidarity with the Islamic Republic of Iran and emphasize that any hostile act against Iran is an act against Palestine and Resistance and we see ourselves in the frontline of supporting Iran,” he said in a Tuesday meeting with Iran&#8217;s Supreme National Security Council, Ali Shamkhani in Tehran.</p>
<p>Al-Arouri appreciated Iran’s support for Palestine, noting that US hostilities and sanctions didn’t impede the resolve of the Islamic Republic in supporting the Palestinian cause.</p>
<p>He went on to say that Hamas is not afraid of Israeli regime’s threats and stands up against their aggressions with the help of God and support of Iran.</p>
<p>For his part, Shamkhani described ‘internal resolve’ and ‘Islamic Resistance’ as the two main elements needed to defeat the Israeli regime.</p>
<p>“The fundamental principle of supporting the Palestinian cause has been among pillars of the Islamic Revolution and this will continue to the full victory of Resistance Front against child-killing occupiers,” Shamkhani said in the meeting.</p>
<p>He went on to say that the so-called ‘Deal of the Century’ is a pre-failed plot which cannot be implemented, adding, “besides the growth of Resistance groups and their increased role in key regional arrangement, the Zionist regime and its allies’ conditions are fragile and deteriorating. And fake plans which oppose the resolve of Palestinian people will not yield any result.”</p>

										<content:encoded><![CDATA[<p>In a letter to National Security Adviser of Afghanistan, Hamdullah Mohib, Secretary of Iran&#8217;s Supreme National Security Council Ali Shamkhani condemned the powerful explosion in Afghanistan’s capital which left dozens of people killed or wounded.</p>
<p>The attack was carried out by the Taliban in an area of Afghanistan&#8217;s capital housing military and government buildings. The car bomb explosion killed at least 16 people, and injured 105, including 51 children, according to government authorities.</p>
<p>In the letter to his Afghan counterpart, Shamkhani stressed the need for expansion of cooperation and common understanding among all countries in the fight against terrorism, adding “terrorists and extremists are targeting all aspects of the ordinary lives of human societies.”</p>
<p>“Undoubtedly, putting an end to such painful moves carried out by extremist groups affiliated with takfiri ideologies is only possible with a serious resolve, cooperation among neighboring countries, and a real fight against terrorism,” Shamkhani stressed.</p>

										<content:encoded><![CDATA[<p>In a note on Saturday, Keivan Khosravi, Spokesman for the Supreme National Security Council, wrote that the upcoming visit of Japan&#8217;s Prime Minister Shinzo Abe to Iran “will definitely be an important event in consolidating and developing friendly relations between the two countries in various fields.”</p>
<p>It is said that Shinzo Abe is coming to Iran as a mediator between Tehran and Washington, he wrote, adding that the success of the Japanese prime minister’s visit could be guaranteed if efforts were made to “return the US to the JCPOA and compensate the losses incurred on Iran,” and to “remove the US extraterritorial sanctions on our country,” which are both accepted and stressed by the international community.</p>
<p>According to Japanese media, Prime Minister Shinzo Abe is expected to make an official visit to Iran from June 12 to 14. The visit will be the first by an incumbent Japanese prime minister since 1978.</p>
<p>Iranian Foreign Ministry Spokesman Abbas Mousavi has dismissed media speculations that the aim of Abe&#8217;s visit is to play an intermediary between the US and Iran amid heightened tension.</p>
<p>The Japanese prime minister last met Iranian President Hassan Rouhani on the sidelines of UNGA meeting in 2013.</p>

										<content:encoded><![CDATA[<p>Keyvan Khosravi made the remarks in an exclusive interview with the Iran Front Page (IFP), in the wake of the country’s decision to reduce its JCPOA commitments.</p>
<p>“Iran’s new decision, which has been made using the capacity of Articles 26 and 36 of the same deal, is the continuation of the path of diplomacy for returning the offending sides to the train of JCPOA commitments,” he said.</p>
<p>“Following the Supreme National Security Council’s decision, the path [to withdrawal] will be pursued nonstop and stage by stage.”</p>
<p>Khosravi stressed that Iran’s decision can lead to two major results, but the extent to which they are achieved depends on how much the audiences of the decision correct their behaviors.</p>
<p>“If the offending sides resume implementing what they had undertaken in the JCPOA and respect Iran’s legal rights, Iran will resume implementing its own JCPOA commitments, as it used to do in the past.”</p>
<p>“In any other situation, where Iran’s legal rights are not secured, Tehran would treat the step-by-step path devised by the SNSC’s new decision, and will go on until full withdrawal from the JCPOA and even beyond that if necessary,” he noted.</p>
<p>Whether the game would be a win-win or a lose-lose one depends on how the ball of JCPOA – which is now in the other side’s court – will move, Khosravi said.</p>
<p>“Diplomacy is the battle of wills for achieving maximum benefits. Nuclear talks were a path in diplomacy for achieving balanced interests based on win-win rule.</p>
<p>“Although the JCPOA was supposed to help realize this goal, the US and Europe turned it into a failure and created a situation where it was totally harmful to remain in the deal. The US did so by pulling out of the international deal and Europe by moving along with the US’ illegal behavior and killing time, which sounded like deceit. Naturally, Iran’s new decision directly addresses the US government and then the European countries who are directly responsible for the current unwanted situation,” he added.</p>

<p>“Surely we will continue our reciprocal policies in the framework of JCPOA and NPT,” he added.</p>
<p>The remarks came after the Supreme National Security Council ordered so stop implementation of some parts of commitments of the Islamic Republic of Iran under the JCPOA according to articles 26 and 36 of the agreement. According to the statement, Iran will no longer commit to the restrictions put on the storage of enriched uranium and heavy water under the agreement.</p>
<p>The remaining parties to the nuclear deal have been given 60 days to implement their commitments under the JCPOA, particularly those related to the banking and oil sectors. Failure to do so will prompt the Islamic Republic to stop complying with restrictions on the level of uranium enrichment and the modernization of Arak heavy water reactor, the statement says.</p>
<p>The Iranian MP also said that Iran will enter into ‘serious’ technical negotiations with International Atomic Energy Agency and remaining signatories of the Nuclear Deal to “produce our required [nuclear] fuel in different levels.”</p>
<p>He went on to highlight that pulling out of JCPOA and NPT is not on the agenda.</p>

										<content:encoded><![CDATA[<p>“In line with protecting the security and national interests of the Iranian people”, the Supreme National Security Council has ordered stop to implementation of some parts of commitments of the Islamic Republic of Iran under the JCPOA according to articles 26 and 36 of the agreement.</p>
<p>The letter containing the details of Iran’s countermeasures to the US withdrawal from the agreement and its increasing pressure and restrictions against the Islamic Republic since May 2018 was presented to the ambassadors of the five remaining parties to the Iran nuclear deal (JCPOA) &#8211; France, Germany, UK, Russia and China – on Wednesday morning, a few hours before President Rouhani went live on a television broadcast to discuss the decision in length.</p>
<p>According to the decision of the Supreme National Security Council, Iran will no longer commit to the restrictions put on storage of enriched uranium and heavy water under the agreement.</p>
<p>The remaining parties to the nuclear deal have been given 60 days to implement their commitments under the JCPOA, particularly those related to the banking and oil sectors. Failure to do so will prompt the Islamic Republic to stop complying with restrictions on the level of uranium enrichment and the modernization of Arak heavy water reactor, the statement says.</p>
<p>“At any given time that our demands are met, we will resume complying with the stopped commitments; otherwise, we will continue to stop implementing the other commitments step by step,” adds the statement by the Supreme National Security Council.</p>
<p>“Iran is ready to continue its consultations with the remaining parties to the JCPOA on all levels,” the statement notes. “However, Iran will respond decisively and immediately to any irresponsible act, such as referring the issue to the UN Security Council or the imposition of more sanctions.”</p>
<p>The statement further stresses that the failure of the JCPOA and any possible consequence will be fully upon the United States and the remaining parties to the nuclear deal.</p>
