										<content:encoded><![CDATA[<p>TEHRAN (<a href="https://www.irannewsdaily.com/">Iran News</a>) &#8211; A federal judge on Friday dismissed a bid by Rep. <span class="rollover-people" data-behavior="rolloverpeople">Louie Gohmert</span> (Texas) and other Republicans that sought to endow Vice President Pence with the legal authority to effectively overturn <a href="https://irannewsdaily.com/category/international/">President-elect <span class="rollover-people" data-behavior="rolloverpeople">Joe Biden</span>’s electoral win.</a></p>
<p>In his ruling, Texas-based U.S. District Judge Jeremy Kernodle, a Trump appointee, said the GOP plaintiffs lacked standing. The judge found that Gohmert suffered no legally recognizable injury.</p>
<p>The other plaintiffs, a group of Arizona Republicans who self-identify as an alternate “slate” of pro-Trump electors, could not link their supposed injury to Pence, he reasoned.</p>
<p>“Because neither Congressman Gohmert nor the nominee-electors have stood here, the court is without subject matter jurisdiction to address” their lawsuit, Kernodle wrote in his ruling. “The court, therefore, dismisses the case without prejudice.”</p>
<p>In an appearance on conservative media outlet Newsmax Friday evening, Gohmert said that his legal team is planning to appeal the decision to the Fifth Circuit Court of Appeals, condemning the district court’s ruling that he lacks a legal right to sue in the case.</p>
<p>&#8220;I believe in using the court system for the same reason they were created &#8230; to resolve disputes,” Gohmert said.</p>
<p>“I still believe in that system,” he said, adding that he hoped once lawmakers were presented with evidence on allegations of voter fraud, “people will come to the right conclusion.”</p>
<p>“If not, it will mean the end of our republic,” he asserted.</p>
<p>Attorneys for Gohmert and his co-plaintiffs, which included Kelli Ward, the chairwoman of the Arizona GOP, did not respond to a request for further comment.</p>
<p>The suit’s dismissal had been expected: The consensus among election law experts was that the judge would toss the case without reaching the core substantive claims alleged by the Republican plaintiffs.</p>
<p>The far-fetched legal effort sought to permit Pence to sidestep federal election law when he presides over a joint session of Congress on Wednesday. Rather than carry out his statutory duty to finalize Biden’s win, Pence would be free to effectively grant himself and <span class="rollover-people" data-behavior="rolloverpeople">President Trump</span> a second term.</p>
<p>The vice president’s role in presiding over the Jan. 6 meeting is usually a ceremonial one governed by an 1887 federal law known as the Electoral Count Act. But the Republican lawsuit asked the judge to invalidate the law, arguing that it places an unconstitutional constraint on the vice president&#8217;s authority to choose among competing claims of victory when state-level election results are disputed.</p>
<p>The lawsuit was an outgrowth of GOP efforts in several key battleground states to overturn Biden’s win based on the unsubstantiated theory that his victory was tainted by widespread fraud. Republicans in several key swing states have disputed Biden&#8217;s win and offered alternate &#8220;slates&#8221; of pro-Trump electors to be counted Wednesday, but experts say these efforts carry no legal weight.</p>
<p>Pence, for his part, told the court Thursday that he was not a proper defendant to the suit. As vice president, he said, his legal interests are not &#8220;sufficiently adverse to plaintiffs&#8221; to clear the constitutional requirement that there be a &#8220;case or controversy&#8221; before a court weighs in.</p>
<p>&#8220;The Vice President—the only defendant in this case—is ironically the very person whose power they seek to promote,&#8221; wrote a Department of Justice attorney representing Pence. “A suit to establish that the Vice President has discretion over the count, filed against the Vice President, is a walking legal contradiction.”</p>

										<content:encoded><![CDATA[<p>TEHRAN (<a href="https://irannewsdaily.com/" target="_blank" rel="noopener noreferrer">Iran News</a>) – The body of a former Iranian judge Gholamreza Mansouri who was found dead in a hotel in Romania’s capital last month was delivered to Iran on Tuesday.</p>

<div>According to Nour News, the Romanian Police has also submitted a 29-page report to the authorities in Iran.</div>
<div>The body of the 52-year-old judge from Iran was found dead at Bucharest&#8217;s Duke hotel on June 19.</div>
<div>Mansouri, who was accused of taking a 500,000-euro bribe, was a co-defendant in a major financial corruption trial currently underway in Iran that also involves former deputy head of the Judiciary Akbar Tabari, among others.</div>
<div>Iranian authorities had issued an alert for Mansouri’s arrest through the International Criminal Police Organization and requested his extradition to Iran.</div>
<div>The ex-judge was arrested in Romania, but later released from custody and put under police watch.</div>
<div>He was found dead in the lobby of the hotel on June 19. On June 23, Romania said autopsy findings indicated that he had died of the impact from a fall.</div>
<div>Bucharest’s prosecuting unit said in a statement that based on preliminary conclusions from the forensic autopsy, Mansouri&#8217;s death was “caused by traumatic injuries incompatible with life, produced by hitting a hard surface.&#8221;</div>

										<content:encoded><![CDATA[<h3 class="lead">TEHRAN  &#8211; A Spanish judge has withdrawn the European arrest warrants for the former Catalan president, Carles Puigdemont, who fled to Belgium after the Madrid government fired him, and four of his ministers.</h3>

<p>The judge, Pablo Llarena, said the former president and the Catalan cabinet members in Belgium had shown a willingness to return to Spain while withdrawing the warrants also prevented more than one European jurisdiction overseeing the case, The Guardian reported.</p>
<p>Court sources however said Spanish arrest warrants were still in force against the five and they would be detained upon arrival in the country. Official campaigning for a 21 December regional election, called after Puigdemont’s government was dissolved, began on Tuesday.</p>
<p>More than a dozen Catalan leaders are facing possible charges of sedition, rebellion and misuse of public funds in Spain over their roles in October’s illegal independence referendum and the subsequent unilateral declaration of independence.</p>
<p>Llarena also argued that the European warrant would complicate the overall probe into Catalan leaders. He said Belgium could reject some of the reasons behind the warrant, which could possibly reduce the charges and create inequalities with those back in Spain.</p>
<p>Six former Catalan cabinet members facing charges were on Monday granted bail but the deposed Catalan vice-president, Oriol Junqueras, looks set to contest this month’s regional election from a prison cell after a judge at Spain’s supreme court denied him bail, saying it remained to be seen whether his pledge to abide by Spanish law was “truthful and real”.</p>
<p>A Belgian court had on Monday given the five Catalans a 14 December date for a decision on whether to grant a European arrest warrant and extradite them.</p>
