<p><a href="https://irannewsdaily.com/">IRAN NEWS</a> NATIONAL DESK</p>
<p>TEHRAN (MNA) – Iran’s representative in the International Court of Justice (ICJ) said that unjust U.S. sanctions imposed against Iran have targeted daily lives of people of the country.</p>
<p>Hamidreza Oloumi Yazdi, who is Iran’s representative in the case of violation of 1955 Amity Treaty between Iran and U.S., emphasized that U.S. sanctions have specifically targeted the daily lives of Iranian people.</p>
<p>He called on the International Court of Justice (ICJ) to exercise its jurisdiction in this case and follow up the substantive proceedings of the case.</p>
<p>The second and final round of Iran&#8217;s defense in case of violation of the 1955 treaty between Iran and the United States was held yesterday in The Hague due to the U.S. reimposition of sanctions on Iran before the International Court of Justice.</p>
<p>At this stage, Iran&#8217;s representatives and lawyers, while rejecting the baseless and unfounded claims of the United States that the Court did not have jurisdiction to hear the case in its full relationship with JCPOA, stated that U.S. hostile actions in re-imposing sanctions after May 8, 2018 violates various articles of the 1955 Amity Treaty.</p>
<p>The U.S. policy of &#8220;maximum pressure&#8221; on the Iranian people has created many problems (including trade with other countries, imports of vital food and medicine, access to the international banking system and money transfers, rising inflation and the devaluation of the national currency) and in general, these sanctions have left a negative impact on all aspects of people&#8217;s lives, he underlined.</p>
<p>Not only the United States offers a one-sided, unilateral and biased interpretation of the Amity Treaty as well as the rules of the Court, but also has no respect for international principles and rules and UN Security Council Resolution 2231 and has threatened other countries if they comply with this resolution, they will be punished, Oloumi criticized.</p>
<p>After hearing Iran&#8217;s final defense, the International Court of Justice announced end of the hearing. The court is expected to rule on the US objection in the next few months.</p>

										<content:encoded><![CDATA[<p>TEHRAN (<a href="https://www.irannewsdaily.com/" target="_blank" rel="noopener noreferrer">Iran News</a>) – Iran’s representative in the International Court of Justice rejected the inadmissible reasons the US government has given to challenge the ICJ’s jurisdiction to consider a complaint lodged by Tehran against the re-imposition of American sanctions.</p>

<p>In remarks on Wednesday, director of the Iranian Presidency’s Centre for International Legal Affairs and the country’s representative in the International Court of Justice, Hamidreza Olumi Yazdi, said the US has questioned the ICJ’s jurisdiction with the purpose of delaying the legal procedure for hearing Iran’s complaint and the strong evidence for the US violation of the 1955 Treaty of Amity.</p>
<p>The US’ reasons to object to the ICJ’s competence to rule in the case either lack legal basis or are based on groundless allegations against Iran, he added.</p>
<p>Denouncing the illegal re-imposition of US sanctions after its withdrawal from the Joint Comprehensive Plan of Action, Olumi Yazdi said the cruel sanctions have already targeted all sectors of Iran’s economy, including the oil and gas industries, financial and banking sector, automotive and shipping industries, metal production and construction.</p>
<p>The US sanctions have inflicted widespread financial and non-financial damages on the Iranian people and companies, he deplored.</p>
<p>The Iranian official finally reminded the ICJ president and judges that the international court has now a “historic opportunity” to stand against the US government’s unilateralism and law-breaking, to dismiss Washington’s baseless objection, and begin to hear the case.</p>
<p>The International Court of Justice has begun weeklong sessions on the issue of its jurisdiction to consider the complaint filed by Iran against the re-imposition of US sanctions.</p>
<p>Iran began a legal battle before the International Court of Justice in July 2018, after US President Donald Trump re-imposed harsh unilateral sanctions on Tehran, which were suspended under the international agreement on Iran’s nuclear program.</p>
<p>In May 2018, Trump announced the withdrawal of the United States from the nuclear agreement. Later in October, the US faced its first setback in the highest judicial body of the United Nations after the International Court of Justice ordered the suspension of some of the sanctions that were re-imposed on Iran, including goods used for “humanitarian purposes.”</p>
<p>Washington responded immediately by canceling a friendship agreement signed between the two countries in 1955, which the court had relied on to justify its decision.</p>
<p>Iran had asked the International Court of Justice to suspend the sanctions temporarily until the judges decide on the content of the case, which could take years. The court will consider these sessions within its competence to rule in the case, which Washington strongly opposes, Right Now Times reported.</p>
<p>The International Court of Justice was established after the Second World War and examines disputes between states, but it does not have the binding means to implement its decisions.</p>

										<content:encoded><![CDATA[<p class="summary">India has renewed its appeal in the International Court of Justice (IJC) to take an alleged spy off death row in Pakistan, as political and diplomatic tensions soar between the neighbors.</p>
<p>Kulbhushan Sudhir Jadhav, a former Indian navy officer, was arrested in the restive southwestern Pakistani province of Baluchistan in March 2016 on charges of espionage and sentenced to death by a military court in Pakistan.</p>
<p>India insists Jadhav was not a spy and that he was kidnapped in Pakistan. New Delhi is asking that the IJC order Islamabad to annul the sentence.</p>
<p>As IJC resumed its public hearing on the second day at The Hague, Pakistan made a strong statement on Tuesday, presenting evidence of espionage against the alleged Indian spy</p>
<p>Pakistan’s counsel Khawar Qureshi raised nine points in light of evidence pertaining to espionage, Jadhav’s confessional statement, his 17 times travel on fake Indian passport and unlawful claim of consular access under Vienna Convention, according to media reports.</p>
<p>Counsel termed India’s oral arguments &#8211; presented a day earlier &#8211; as “an opportunity wasted”, saying India failed to answer fundamental questions regarding subversive activities of its serving navy commander inside Pakistan.</p>
<p>Calling India’s proposition as “absurd and nonsensical,” he said India was showing lack of good faith and sponsoring terrorism in Pakistan through Jadhav.</p>
<p>The rare foray of India and Pakistan into international courts marks another flashpoint after Thursday&#8217;s suicide bombing in Indian-controlled Kashmir that killed at least 46 Indian troopers.</p>

<p class="summary introtext">International Court of Justice (ICJ) issued an interim order to the United States on Wednesday to lift its sanctions against Iran linked to civil aviation, humanitarian goods, and medicines.</p>

<p>Judges at the International Court of Justice, the principal judicial organ of the UN, have handed victory to Tehran over a case against US which states that the US sanctions imposed in May against Iran violate the terms of their 1955 Treaty of Amity.</p>
<p>In its initial ruling broadly in favor of Iran, the International Court of Justice has demanded the US suspend sanctions on Iran related to humanitarian aid, agriculture, spare parts supplies for civil aviation, and relevant services including banking channels.</p>
<p>The ICJ has ordered the US, in accordance with its obligations under the 1955 Treaty of Amity, Economic Relations, and Consular Rights, to remove, “by means of its choosing”, any &#8220;impediments raising from the measures announced on 8 May 2018 to the free exportation to the territory of the Islamic Republic of Iran of medicines and medical devices, foodstuffs and agricultural commodities; and spare parts, equipment and associated services (including warranty, maintenance, repair services and inspections) necessary for the safety of civil aviation.&#8221;</p>

<p>&#8220;To this end, the United States must ensure that licences and necessary authorizations are granted and that payments and other transfers of funds are not subject to any restriction in so far as they relate to the goods and services referred to above,&#8221; the ruling added.</p>
<p>The Court has unanimously told both parties to “refrain from any action which might aggravate or extend the dispute before the Court or make it more difficult to resolve.”</p>
<p>The Court further reaffirmed that its “orders on provisional measures &#8230; have binding effect” and thus create international legal obligations for both parties.</p>
