										<content:encoded><![CDATA[<p>TEHRAN (<a href="https://irannewsdaily.com/" target="_blank" rel="noopener noreferrer">Iran News</a>) – The EU foreign policy chief, Joseph Borrell said he has received a letter from Iran that demands triggering the dispute resolution mechanism of the 2015 nuclear deal over the failure of the three European signatories to the agreement to honor their commitments.</p>

<p>In a statement released on Friday, Josep Borrell said the letter written by Foreign Minister Mohammad Javad Zarif underlined Iran&#8217;s concerns regarding implementation issues on the part of France, Germany and Britain to the Joint Commission of the deal, officially known as the Joint Comprehensive Plan of Action (JCPOA) for resolution through the dispute process set out in the agreement&#8217;s paragraph 36.</p>
<p>&#8220;The Dispute Resolution Mechanism requires intensive efforts in good faith by all. As Coordinator of the Joint Commission, I expect all JCPOA participants to approach this process in this spirit within the framework of the JCPOA,&#8221; he said, Press TV reported.</p>
<p>Borrell also stressed the significance of the JCPOA and threw his weight behind the historic nuclear pact.</p>
<p>&#8220;As we approach the fifth anniversary of the JCPOA, I should like to take this opportunity to recall the importance of the agreement. The JCPOA is an historic achievement for global nuclear nonproliferation contributing to regional and global security. I remain determined to continue working with the participants of the JCPOA and the international community to preserve it,&#8221; he said.</p>
<p>Russia’s Permanent Representative to International Organizations in Vienna Mikhail Ulyanov also confirmed that the Islamic Republic had requested the Joint Commission of the JCPOA to address Tehran’s concerns regarding implementation of the deal by the European trio through the dispute resolution mechanism.</p>
<p>&#8220;This is the third time when JCPOA participants try to launch DRM which lacks clear and agreed procedure,&#8221; he tweeted early on Saturday.</p>
<p>Iran&#8217;s Foreign Ministry spokesman Seyyed Abbas Mousavi said Zarif&#8217;s letter came after France, Germany and the UK introduced the anti-Iran resolution passed by the International Atomic Energy Agency&#8217;s Board of Governors last month.</p>
<p>“Following the irresponsible and illegal measure by the three European states &#8230; to initiate a draft resolution at the International Atomic Energy Agency’s Board of Governors and also the continuation of noncompliance with the international commitments under the JCPOA &#8230;, the Minister of Foreign Affairs of the Islamic Republic of Iran yesterday sent a letter to Mr. Borrell &#8230; and once again referred the cases of the European countries’ noncompliance according to Article 36 of the JCPOA to the Joint Commission for settlement,” Mousavi said on Friday.</p>
<p>Passed by a 25-2 margin with seven abstentions on June 19, the IAEA resolution called on the Islamic Republic to “fully cooperate” with the IAEA and “satisfy the Agency’s requests without any further delay,” including by providing “prompt” access to two nuclear sites.</p>
<p>Iran said the document is based on anti-Iran allegations raised by Israel and serves American goals.</p>
<p>In May 2018, the US unilaterally withdrew from the JCPOA and re-imposed anti-Iran sanctions.</p>
<p>Verified by the IAEA, Iran remained fully compliant with the JCPOA for an entire year, waiting for the co-signatories to honor their commitments.</p>
<p>As the European parties continued to renege on their obligations, the Islamic Republic moved in May 2019 to suspend its JCPOA commitments under articles 26 and 36 of the deal covering Tehran’s legal rights.</p>

										<content:encoded><![CDATA[<p>TEHRAN (<a href="https://irannewsdaily.com/" target="_blank" rel="noopener noreferrer">Iran News</a>) &#8211; The EU foreign policy chief Josep Borrell said on Friday he had extended the timeline for discussing ways to save the 2015 nuclear deal with Iran under a dispute mechanism triggered by France, Germany, and Britain.</p>
<p>“There is an agreement that more time is needed due to the complexity of the issues involved. The timeline for  dispute mechanism is therefore extended,” Borrell said in a statement.</p>
<p>“All JCPOA participants reconfirmed their determination to preserve the agreement which is in the interest of all,” he said, using the acronym for the Joint Comprehensive Plan of Action which is the official name of the Iran deal.</p>
<p>On January 14, Borrell was notified by Paris, London, and Berlin that they had triggered the dispute mechanism, in theory starting a 15-day process to resolve issues with Iran. However, in practice it is not clear when the 15-day period should start because Iran has not formally recognized the consultation process, officials have said.</p>
<p>Borrell said the Joint Commission that regulates the Iran nuclear deal will meet in February but did not give a date.</p>
<p>Speaking at the World Economic Forum in Davos, Switzerland, German Chancellor Angela Merkel warned against prematurely scrapping the international nuclear deal with Iran, saying that it would be wrong to abandon an “imperfect” deal with nothing better in place.</p>
<p>Britain, France, and Germany – collectively known as the EU3 or E3 – launched the process last week charging Iran with failing to observe the terms of the multinational nuclear agreement, a move that could eventually see the UN Security Council reimpose international sanctions on the country.</p>
<p>Iran has criticized the three European nations for inaction over sanctions the United States reimposed after unilaterally withdrawing from the landmark accord in May 2018.</p>
<p>Iran has rejected the European move to trigger the dispute mechanism of the deal, saying it &#8220;has no legal basis.&#8221;</p>
<p>The 2015 nuclear deal reached with Britain, China, France, Germany, Russia, and the United States gave Iran relief from sanctions in return for curbs on its nuclear program.</p>
<p>A year after the US pullout, Iran began to roll back its commitments to the accord in retaliation.</p>
<p>Iran&#8217;s latest and final step in January entailed forgoing the limit on the number of machines used to make uranium more potent.</p>
<p>Iran has said it will return to its nuclear obligations if the European signatories hold their part of the bargain.</p>
<p>“The very day you return to your commitments, we will live up to our own commitments,” President Hassan Rouhani said Wednesday.</p>
<p><strong>EU stance</strong></p>
<p>The Wall Street Journal cited European diplomats as saying that the E3 will avoid triggering sanctions against Iran.</p>
<p>The US daily reported on Thursday that European diplomats don&#8217;t expect Iran to reverse the suspension of its nuclear deal commitments and that the diplomats &#8220;privately say they are prepared to tolerate those steps&#8221;.</p>
<p>According to the WSJ report, European diplomats are seeking to persuade Iran against taking major &#8220;new nuclear steps Iran has not taken yet&#8221; and &#8220;restrain&#8221; the expansion of its nuclear activities.</p>
<p>The report added that European officials are currently divided, however, on what would constitute as a restrained approach from Iran, with some proposing that Tehran’s &#8220;modest&#8221; continued expansion of its uranium production would be acceptable.</p>

<p>While enumerating mistakes and impracticality of European countries involved in Iran’s nuclear talk [including France, UK, and Germany] with regards to lack of fulfilling their commitments under JCPOA, Zarif said, “the recent claim taken by Europeans&#8217; officials in activating Dispute Resolution Mechanism (DRM) is rejected.”</p>
<p>Zarif met and held a talk with Josep Borrell for the first time since his appointment as EU foreign policy chief and congratulated his appointment and added, “The Islamic Republic of Iran is ready to establish close cooperation and collaboration with him in this regard.”</p>
<p>Iranian foreign minister also called on European countries involved in Iran’s nuclear deal to revise their behaviors with Iran and also Joint Comprehensive Plan of Action (JCPOA).</p>
<p>France, Britain, and Germany confirmed on Tuesday that they had triggered the dispute mechanism in the Iran nuclear deal, but said they were not joining the United States campaign to exert maximum pressure on Tehran.</p>

<p>“It is not an understatement to say that the recent tensions in Iraq and in the surrounding region have the potential to erase the hard-won progress of recent years, thereby affecting the lives of millions of people,” said Borrell at the European Parliament plenary debate on the situation in Iran and Iraq following recent escalations on Tuesday, according to official website of the European Union.</p>
<p>“This is also why I convened an extraordinary Foreign Affairs Council on Friday, coming back from Croatia sooner than expected, from which I received a strong mandate to carry out all necessary diplomatic efforts to contribute to the de-escalation in the region, support political dialogue and promote a political regional solution, these are the precise words of the conclusion of the Council,” he added.</p>
<p>“While it may appear as if – for the moment &#8211; the current situation will not escalate further, we – and I personally &#8211; have since the very beginning of this crisis been active in urging calm, restraint and de-escalation to all of the relevant parties inside and outside the region: from Iran to Iraq, to the UAE, to the United States, Turkey, Russia, China, and others. We want to ensure that everyone with influence uses that influence to good effect and that we reach a temporary calm,” EU Foreign Policy Chief noted.</p>
<p>He went on to say, “Well, the current situation in Iraq, and the risk of further military escalation, could jeopardize the substantial achievements instability and in particular the fight against Daesh in recent years. The current situation could generate a number of dangerous consequences: the resumption of Da’esh would have a catastrophic humanitarian impact, possibly leading to a dramatic increase in the number of displaced persons.”</p>
<p>“The situation in Iran is also something that we continue to follow closely. We have had a number of tragic incidents; the Ukraine International Airlines plane crash on 8 January which killed all 176 on board, including a high number of EU citizens. Iran has now taken responsibility for this crash. As I said in my statement on 11 January, this was a deplorable tragedy, and once again, I want to extend my condolences to the victims’ families,” Borrell added.</p>
<p>“A failure to preserve the deal will only add tensions in the region. Imagine for a second what would be the situation today if Iran had nuclear weapons. And they would have been able to obtain those without the JCPOA,” he said.</p>
<p>EU Foreign Policy Chief mentioned, “Iran announced its fifth and – according to its own announcement &#8211; final step in the reduction of its nuclear commitments under the deal. This is a worrisome announcement, but it is important to see what the International Atomic Energy Agency reports on how Iran implements this step. As the Coordinator of the JCPOA, I have been in touch with all the participants on the diplomatic way forward, seeking to preserve unity in the group.”</p>
<p>Referring to the dispute resolution mechanism, he said, “As Coordinator of the Joint Commission, I will guarantee that the Dispute Resolution Mechanism provides an opportunity to address the issues indicated by France, Germany, and the UK. I will oversee this process, and I will be in touch with all the participants on the next steps.”</p>
<p>“I want to underline here that the Dispute Resolution Mechanism is first and foremost a process to resolve issues related to the deal implementation. The objective of the Dispute Resolution Mechanism will be therefore to find solutions and return to full compliance within the framework of this deal. It is not a matter of putting sanctions – as I saw some newspapers had been claiming this morning. All remaining participants in the agreement have been clear of their determination to preserve the JCPOA. This unity is crucial and I intend to work hard to preserve it,” he added.</p>
<p>France, Britain, and Germany confirmed on Tuesday that they had triggered the dispute mechanism in the Iran nuclear deal, but said they were not joining the United States campaign to exert maximum pressure on Tehran.</p>
